Electronic Disclosure And Consent
These Terms shall become effective as of January 1, 2024.
In this contract, the terms “we,” “us,” “our,” and “Turbo Funds LLC” refer to Turbo Funds LLC, its subsidiaries, and affiliated entities. The terms “you” and “your” pertain to the business entity that registers for a Turbo Funds LLC account or utilizes a Turbo Funds LLC service. “Communications” encompass a range of materials we provide or request from you, such as disclosures, notices, agreements, fee schedules, privacy policies, statements, records, documents, and other relevant information.
Turbo Funds LLC is committed to offering an exceptional online banking experience, which includes electronically delivering information to you. By agreeing to this contract, you are expressing your willingness and capability to receive Communications electronically, and you are providing your consent for electronic receipt of Communications. If you choose not to consent to electronic (instead of paper) Communications, you are ineligible to open a Turbo Funds LLC account. Should you retract your consent for electronic Communications after initially providing it, we hold the right to close your account.
Methods of Communication Delivery
Our primary method of delivering Communications to you will be electronic, either through the Turbo Funds LLC website (www.turbofunds.com), the Turbo Funds LLC mobile application (“App”), text or SMS messages (“Text Messages”), or via electronic mail (“Email”). If we do not use these methods, we will inform you of alternative ways to access such Communications.
Despite your consent for electronic delivery, certain laws may necessitate that we provide specific Communications to you in paper form.
Technical Requirements
To successfully receive and keep electronic Communications from Turbo Funds LLC, you will need:
- A computer or mobile device with an operating system capable of supporting the following;
- An active internet connection;
- A supported web browser, including Edge (version 42 or higher), Firefox (version 62 or higher), Safari (version 12 or higher), or Chrome (version 69 or higher);
- A storage solution for data retention (such as a hard drive);
- A valid, active email address;
- Software capable of displaying PDF files.
We may periodically update these requirements to ensure our ability to provide electronic Communications. If there is a significant change in these requirements, we will inform you of these updates.
Updating Your Contact Information
It’s your responsibility to maintain current and accurate contact details to ensure receipt of our electronic Communications. You can update your email address and other contact information by emailing us at info@turbofunds.com.
Requesting Paper Copies
Although we might occasionally offer paper copies of certain electronic Communications, this does not establish a continuous obligation to do so. If you desire a paper copy of an electronic Communication, you can print it yourself or request a mailed copy by contacting us at systems@turbofunds.com.
Communications in Written Form
Legally, we are obliged to provide specific information to you in writing. All Communications, whether electronic or paper, will be considered as delivered “in writing.”
Withdrawing Your Consent
You are entitled to withdraw your consent to this agreement anytime. Withdrawing your consent will result in the termination of your Turbo Funds LLC account, including access to our Website and Mobile App. Depending on the terms of this Agreement, a refund check for any balance may be issued upon account termination.
